By submitting your application materials through Tripepi Smith Talent Solutions, a division of Tripepi Smith and Associates, Inc., hereinafter TSTS/TSA, you agree to the following terms:
Role of TSTS
TSTS/TSA serves as a recruitment partner for client agencies, acting as an intermediary between applicants and client agencies. TSTS/TSA facilitates the hiring process by identifying qualified candidates for client consideration based on submitted materials and qualifications from applicants. Final decisions regarding interviews, candidate selection and hiring are made by the client agency. TSTS/TSA does not make hiring decisions or offer employment.
Accuracy of Application Materials and Indemnification
You affirm that all information provided in your application, resume, cover letter or other related materials is truthful and accurate to the best of your knowledge. You agree to indemnify, defend and hold harmless TSTS/TSA, its officers, employees, agents, contractors and affiliates against any claims, liabilities, damages, losses or expenses (including attorney’s fees) arising from:
- Any false, misleading, or materially inaccurate statements made in your application materials;
- Any actions, misconduct, or negligence on your part during or after the hiring process;
- Any legal violations or infringement of third-party rights associated with your application or subsequent employment.
Release of Claims
To the fullest extent allowed by law, you release and discharge TSTS/TSA and its representatives from any and all claims or liabilities arising from:
- A client agency’s decision not to interview or hire you;
- Any employment-related disputes or outcomes following your referral by TSTS/TSA;
- The inability of TSTS/TSA to secure you a position.
You understand that by agreeing to this release, you are waiving any rights you may have under California Civil Code Section 1542, which states:
“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
Social Media and Background Review
As part of the recruitment process, you consent to TSTS/TSA or its client agencies conducting a review of publicly available online and social media content, as well as any other relevant background checks as required by the client. These searches are intended to assess alignment with the values and expectations of the hiring agency. However, we will not use information from social media to discriminate against you based on protected characteristics such as religion, sexual orientation or pregnancy status.
Public Records Act (PRA) Notice
You understand by agreeing to this release, materials submitted for public sector positions may be subject to disclosure under the California Public Records Act (PRA), depending on the practices and legal obligations of the hiring agency. While TSTS and its client agencies will take reasonable steps to protect personal information, absolute confidentiality cannot be guaranteed.
